On 1st October 2006 The Regulatory Reform (Fire Safety) Order 2005 came into force in England and Wales, radically altering fire legislation.

The Fire Safety Order, as it is known, represents the most significant change to fire safety legislation for over 35 years.  The Order repeals and replaces the Fire Precautions Act 1971 and the Fire Precautions (Workplace) Regulations 1997 (as amended 1999) and introduces a single fire safety regime covering the majority of premises, with the exception of single private dwellings.

The Order will require the 'responsible person' for a premises to carry out a fire safety risk assessment of the premises and based on the findings of the risk assessment provide appropriate fire safety measures to address the risks identified.

It is the Fire Authorities who will have a duty under the Order to enforce the new legislation and will carry out an inspection programme on premises based on risk.
