The following executive decisions have been made by officers under delegated powers.

They are recorded and published in accordance with the Local Authority (Executive Arrangements) (Meetings and Access for Information) (England) Regulations 2012.

Process for determining applications for Neighbourhood Plan Areas to be designated

RESOLVED that delegated authority is given to the Director of Legal and Planning Services in consultation with the Portfolio Holder for Strategic Planning and relevant ward members to make decisions on applications for Neighbourhood Plan Area designation, provided such applications are made by a Town or Parish Council for their own parished area.

Delegated Authority from the Licensing & Appeals Committee to the Director of Housing, Leisure & Property Services for homeless decisions

RESOLVED that delegated authority be granted to the Director of Housing, Leisure & Property Services to conduct reviews of Council Homeless decisions.

 Arrangements for the discharge of functions

To give delegated authority to the Director of Legal and Planning Servies in consultation with the Chief Executive and group leaders to amend the Constitution to reflect the structure changes.

 New Corporate Plan 2016-20

RESOLVED that authority be delegated to the Chief Executive in consultation with the Leader of the Council to determine the format of the consultation exercise to be undertaken through 'Broxtowe Matters' newsletter.

The Plan will help to achieve the Council's key priorities and associated objectives.

 Contract for the Provision of Gas & Electricity Supply

RESOLVED that authority be delegated to the Deputy Chief Executive, in consultation with the three group leaders, to award the contract, in order to enable due diligence to take place with regard to the Council's purchaisng strategy.

This will assist with the Council's objective of delivering value for money.

2 June 2015 - Cabinet

 Irrecoverable Arrears

RESOLVED that the arrears in excess of £1,200 on national non-domestic rates, council tax, rents, housing/council tax benefit overpayment and sundry debtors as set out in the report be written off and to note the exercise of the Deputy Chief Executive's delegated authority under financial regulation 5.9.

This will assist with the Council's cross cutting themes of cost effectiveness and excellence in front line service delivery.

21 April 2015 - Licensing & Appeals

Delegation to Head of Public Protection for consideration and decision of requests to licence vehicles outside the Council's exceptional condition policy

RESOLVED that the Head of Public Protection be granted delegated authority to issue licences for hackney carriage and private hire vehicles which are outside of the current age limits under the Council's exceptional condition policy with effect from 22 April 2015.

 Building Control Service

RESOLVED (1) that the Head of Neighbourhoods and Prosperity with the agreement of the Director of Legal and Planning Services has authority under S101 of the Local Government Act 1972 to delegate any functions necessary, conducive or incidental to the operation of the building control service to officers of Erewash Borough Council.  (2) The Director of Legal and Planning Services, in consultation with the Resources portfolio holder be authorised to enter into a partnership agreement.

This will assist with the Council's objective to provide continuous improvement and value for money.

Combined Authority for Nottinghamshire

RESOLVED that delegated authority is granted to the Chief Executive in consultation with the Leader of the Council to amend the documents to be submitted to the Secretary of State following the consultation exercise.

This will assist with the Council's priority of Jobs and Business growth.

Shared Service Homelessness - Housing Services

RESOLVED that:

Authority be delegated to the Director of Housing, Leisure and Property Services in consultation with the Leader, to pilot the Council directly letting privated reented properties.

This will assist with the Council's priority of jobs and business growth by investing in and the development of its workforce.

Beeston Town Centre - Investment Requests from Beeston Advisory Committee

RESOLVED that:

1. Proposals for the installations of LED uplighting for Beeston Parish Church and the clearance of the former Beeston Market site be approved.

2. Delegated authority be given to the Director of Housing, Leisure and Property Services in consultation with Leader to fund any overspend from the Policy Reserve.

This will assist with the Council's priorities of jobs and business growth, the environment and bringing people together.

Redress Schemes for Lettings Agency and Property Management Work

RESOLVED THAT:

1. The Chief Executive and the Director of Legal and Planning Services be given delegated authority to act on behalf of the Council in respect of The Redress Schemes for Lettings Agency Work and Property Management Work (Requirement to Belong to a Scheme etc.) (England) order 2014.

2. The monetary penalty for non-compliance shall be set at £5,000, except where there are extenuating circumstances when the level will be decided by the Chief Executive or the Director of Legal and Planning Services, in consultation with the Head of Public Protection.

This will assist with the Council's corporate priority to provide good quality affordable homes for all.

Discretionary Powers to Reduce Council Tax

RESOLVED that the Authority adopt the Policy on Discretionary Council Tax discounts and delegation of responsibility for assessing and determining applications to the Deputy Chief Executive.

This will assist with the Council's objective of securing continuous improvement and delivering value for money.

25 November 2014 - Cabinet

 This will assist with the Council's corporate priority of community safety.Anti-Social Behaviour, Crime and Policing Act 2014

RESOLVED that:

1. The legislative changes be noted;

2. The Chief Executive, the Director of Housing, Leisure and Property Services and the Director of Legal and Planning Services be given delegated authority to act on behalf of the Council in respect of the following parts of the Anti-Social Behaviour, Crime and Policing Act 2014: Part 1 (Injunctions), Part 4 Chapter 1 (Community Protection Notices), Part 4 Chapter 2 (Public Spaces Protection Orders), Part 4 Chapter 3 (Closure Powers), Part 5 (Recovery of possession of a dwelling house on ASB grounds).  Provided that the instigation of Court proceedings in any case is reserved to the Director of Legal and Planning Services in consultation with the Chief Officer with responsibility for the service.

3. The Chief Executive and the Director of Housing Leisure and Property Services be delegated authority to authorise officers to issue Fixed Penalty Notices under the Act.

4. The power to use Fixed Penalties for Community Protection Notices and Public Spaces Protection Orders be adopted, with the penalties being set at £75 with a reduction to £50 if paid within 14 days.

This will assist with the Council's corporate priority of community safety.

Section 106 Requirements Beeston Business Park and Alliance Boots Planning Applications

RESOLVED that the final agreement on the terms of the S106 agreements be delegated to the Chief Executive on consultation with the Leader of the Council.  The final agreement of the memorandum of understanding be delegated to the Chief Executive in consultation with the Leader of the Council.

This will assist with the Council's priority of Jobs and Business Growth.

 Take over of Local Land Charges Service by Land Registry

RESOLVED that delegated authority be given to the Director of Legal and Planning Services, the Resources Portfolio Holder and the Leader to:

1. Correspond with the relevant Government Department to relay the Council's continued objections to the proposals.

2. Support the LGA in seeking to have this clause removed from the Infrastructure Bill subject to the costs of any such action being within existing budget provision.

This will assist with the Council's objective to deliver value for money.

Chilwell Road Hardship Fund

RESOLVED that delegated authority be given to the Deputy Chief Executive in consultation with the Leader and Portfolio Holder to allocate any further monies provided by Nottinghamshire County Council or Nottingham City Council to the budget for this purpose.

This will assist with the Council's value of a strong caring focus on the needs of communities and supporting local businesses.

RESOLVED that delegated authority be given to the Director of Legal and Planning Services and the Director of Environment to finalise and undertake the publication of the Notice of proposals

 

This will assist with the Council's cross cutting theme of cost effectiveness.

RESOLVED that delegated authority be given to the Director of Housing, Leisure and Property Services to agree the detailed terms of the agreements with the Director of Legal and Planning Services.

This will assist with the Council's priority of brining people together and the objective of encouraging healthy participation in the arts, culture and leisure.

RESOLVED that delegated authority be given to the Director of Legal and Planning Services to enter into any agreement necessary to give effect to the Joint Car Park Management arrangement including delegations under S101.

RESOLVED that delegated authority be given to the Director of Environment to conclude the sale of the land at Hassocks Lane, in consultation with the three political group leaders.

Affordable Housing

RESOLVED that delegated authority be given to the Director of Housing, Leisure and Culture and the Deputy Chief Executive, in consultation with the Leader of the Council, to add the sites at Midland Avenue, Stapleford, Linwood Crescent, Eastwood and Hickings Lane, Stapleford to development partnership proposals with Nottingham Community Housing Association on the basis as set out in the report and optimise the available level of resources from the Homes and Communities Agency.

This will assist with the Council's priority to provide good quality affordable homes for all residents.

Grant Aid requests from Parish and Town Councils

RESOLVED that Kimberley Town Council be awarded up to £7,000 of grant aid towards the renovation of Kimberley war memorial in 2013/14 to be funded from capital contingencies with delegated approval as to the final amount given to the Deputy Chief Executive in consultation with the Leader.

This will assist with the Council's priority of bringing people together and the need to deliver value for money.

New Leisure Centre Development

RESOLVED that the Council agree to the Heads of Terms for a lease as attached at appendix 2 and to delegate authority to the Director of Housing, Leisure and Culture to negotiate an Agreement for Lease in consultation with the Leader, Portfolio Holder, the Deputy Chief Executive and Head of Legal Services.

This will assist with the Council's priority of bringing people together and the objective of encouraging healthy participation in the arts, culture and leisure.

RESOLVED that the Director of Environment, in consultation with the Leader of the Council, be given delegated authority to determine the boundary with Devonshire Avenue car park.

RESOLVED that the position statement for the LGA peer review be approved and authority be delegated to the Chief Executive to make minor amendments to the document to ensure it remains up to date.

Capital Grants to Voluntary Organisations 2013/14

RESOLVED that delegated authority be given to the Deputy Chief Executive, in consultation with the Leader of the Council, to enable the move of Kimberley Miners Welfare Football Club to The Stag Recreation Ground, Kimberley.

The grant aid will assist with the Council's key priority of bringing people together through the objective of encouraging healthy participation in arts, culture and leisure and by promoting equality and fairness.

Local Authority Mortgage Guarantee Scheme

RESOLVED that delegated authority be given to the Deputy Chief Executive, in consultation with the Housing and Resources Portfolio Holders, to consider the introduction of a Local Authority Mortgage Scheme and to report back accordingly.

This will assist with the Council's housing priority and the desire for continuous improvement and delivering value for money.

RESOLVED that delegated authority be given to the Head of Legal Services and the Director of Environment to finalise and undertake the publication of the Notice of Proposals.
