Closure Order to Stop Anti-Social Behaviour in Awsworth

24/10/2016 - Broxtowe Borough Council in partnership with Nottinghamshire Police has successfully obtained a Closure Order for a property in Awsworth.

The Council obtained the order on 12th October at Nottingham Magistrates Court to stop an anti-social behaviour problem at 77 Main Street, following complaints of nuisance and criminal activity which was having a detrimental impact on neighbours and the community as a whole. The order allows the property to be closed for 3 months until 12th January 2017.

Efforts to tackle the anti-social behaviour started in 2014 and an injunction was obtained in November 2015 but despite Council's intervention the anti-social behaviour continued with the injunction breached and the perpetrator was imprisoned. Since his release in May the behaviour has started again so the Council has taken the unusual step of applying to the Magistrates court for a Closure Order.

The Closure Order is made possible under Section 80 of the Anti-Social Behaviour Crime and Policing Act 2014. These powers are designed to allow local authorities and police forces, working in consultation with each other to take rapid and effective action against activity that causes great harm to communities.

When the local authority or the police assess the need for a Closure Order they have to have reasonable grounds for believing that one of the following has taken place:

a)    a person has engaged, or (if the order is not made) is likely to engage, in disorderly, offensive or criminal behaviour on the premises, or

b)    the use of the premises has resulted, or (if the order is not made) is likely to result, in serious nuisance to members of the public, or

c)    there has been, or (if the order is not made) is likely to be, disorder near those premises associated with the use of those premises

d)    And the order is necessary to prevent the behaviour, nuisance or disorder from continuing, recurring or occurring

If a Closure Order is granted by the Magistrates Court this triggers an automatic ground for possession.
