Governance Arrangements

The Local Government Act 2000, (as amended by the Localism Act 2011) sets out the statutory provisions that local authorities must follow in determining or changing their governance arrangements. The Act requires that a local authority must make a formal resolution to make a change in its governance from a Committee to Leader and Cabinet form of arrangements, after which, without a referendum, the Council may not change its governance arrangements for five years. The five-year period runs from the date of the last resolution taken to change governance arrangements.

About the Forward Plan

Under the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 a formal notice ,the Forward Plan has to be published 28 calendar days before the decision is taken.  This includes decisions to be taken by the Council Executive or by the Collative Executive which are exempt and have to be taken in private including the reasons why it has to be held in private.

Where it has not been possible to give 28 calendar days’ notice key decisions can be taken under urgency procedure and a notice will be published on the Councils website providing information of the decision to be taken, by whom and the reasons for urgency.

What is a key decision?

A Key Decision is defined under Regulation 8 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 and is a decision made or to be made in connection with the discharge of an Executive function which is likely to:-

6.6.1    result in in the Council incurring revenue or capital expenditure or savings of £250,000 or more; or

6.6.2     be significant in terms of its effects on communities living or working in an area comprising two or more Wards or electoral divisions in the Council’s area

Exempt decisions to be taken in private

If there are exempt items on the Forward Plan Members of the public may make representations to Democratic Services to review their exempt status within ten calendar days of the publication of the Forward Plan. A further notice of an exempt item will be published at the same time as the agenda (five clear working days before the day of the meeting) which will provide details of any representations made and the Council’s response.
