Cossall Neighbourhood Plan Adoption

Following a successful referendum result, Broxtowe Borough Council resolved to ‘make’ (adopt) the Cossall Neighbourhood Plan at its meeting of Cabinet on 12 March 2024. The Borough Council has prepared a ‘Decision Statement(.pdf)(865KB)(Opens in New Window)’ (Opens in a New Window) to accord with the requirements of Regulation 19 of the Neighbourhood Planning (General) Regulations 2012 (as amended). This provides further information in relation to this decision. The Cossall Neighbourhood Plan will therefore now be used when making decisions on planning applications within the pre-April 2023 Cossall Parish, alongside Broxtowe Borough Council's Local Plan.

Cossall Neighbourhood Plan Referendum

A referendum was held on Thursday, 15 February 2024 on the Neighbourhood Plan for Cossall. The question asked in the referendum was:

“Do you want Broxtowe Borough Council to use the Neighbourhood Plan for Cossall to help it decide planning applications in the neighbourhood area?”

Referendum Results

The results of the referendum are as follows:

The number of votes cast in favour of ‘Yes’ was 115 (93.5%) and those in favour of ‘No’ was 8 (6.5%). The turnout was 26.28%.

The referendum results will be considered by Broxtowe Borough Council’s Cabinet at its meeting on 12 March 2024 (6pm). Further information will be available on Broxtowe Borough Council’s website page for this meeting (Opens in a New Window) of Cabinet, one week prior to the meeting.

Independent Examination and Decision to Proceed to Referendum

Jill Kingaby BSc (Econ) MSc MRTPI was appointed to undertake the Independent Examination of the Cossall Neighbourhood Plan. The Independent Examiner’s Report(.pdf)(383KB)(Opens in New Window) (Opens in New Window) was received by the Borough Council on 9 November 2023.

The Cossall Neighbourhood Plan and the Independent Examiner’s Report was considered by Cabinet at its meeting on 5 December 2023. Further information is available on the Borough Council’s website page for the 5 December 2023 Cabinet Meeting (Opens in a New Window).

Cabinet resolved to amend the Neighbourhood Plan as recommended by the Independent Examiner’s Report. Cabinet also resolved that the Neighbourhood Plan, as modified, meets the Basic Conditions. Cabinet resolved that the Plan should proceed to referendum, as confirmed by the Borough Council’s Decision Statement(.pdf)(841KB)(Opens in New Window) (Opens in a New Window).

Correspondence relating to the Independent Examination:

On 31st July 2023, the Independent Examiner sent the Borough Council and Parish Council a ‘Procedural Letter(.pdf)(210 KB)(Opens in New Window)’ (Opens in a new Window).

Neighbourhood Plan Submission:

Cossall Parish Council submitted the Cossall Neighbourhood Plan to Broxtowe Borough Council on Thursday 9th March 2023.

In accordance with Regulation 16 of the Neighbourhood Planning (General) Regulations 2012 (as amended), Broxtowe Borough Council consulted upon the draft Cossall Neighbourhood Plan.

The consultation ended on Friday 14th July 2023.

Consultation Responses:
