Chetwynd: The Toton and Chilwell Neighbourhood Plan Referendum.

A referendum is to be held on Thursday, 2 May 2024 on the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The question to be asked in the referendum will be:

“Do you want Broxtowe Borough Council to use the Neighbourhood Plan for Chetwynd: Toton and Chilwell to help it decide planning applications in the neighbourhood area?”

Decision Statement

Cabinet resolved at its meeting on Tuesday, 6th February 2024, that:

  1. The Chetwynd: The Toton and Chilwell Neighbourhood Plan should be modified as proposed by the Independent Examiner.
  2. Once modified as proposed by the Independent Examiner, it is considered the Neighbourhood Plan will meet the Basic Conditions and other legislative requirements.
  3. The Chetwynd: The Toton and Chilwell Neighbourhood Plan should proceed to a referendum, with the extent of the area eligible to vote to be based upon the Chetwynd: The Toton and Chilwell Neighbourhood Area as shown within appendix 1 to the report.

Independent Examination

Jill Kingaby BSc (Econ) MSc MRTPI was appointed to undertake the Independent Examination of the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The Independent Examiner’s Report(.pdf)(481KB)(Opens in New Window) (Opens in a New Window) for the Chetwynd: The Toton and Chilwell Neighbourhood Plan was received by the Borough Council and Neighbourhood Forum on 17 January 2024. Public Consultation: Proposed Amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan/Consultation Responses

In response to the Independent Examiner’s Procedural Letter of 13th July 2023 (Opens in a New Window), Broxtowe Borough Council invited comments on the proposed amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan and the Policies Map during a 4 week period which ended on Friday 25th August 2023. This consultation period has now ended.

The proposed amendments to the Chetwynd: The Toton and Chilwell Neighbourhood Plan are set out within a ‘Consultation Document(.pdf)(16.8MB)(Opens in New Window)’ (Opens in a New Window). Some of the proposed amendments are shown by ‘track changes’, although some sections (including the proposed amended policies) are not shown in this format, to allow greater clarity. An ‘Explanatory Document(.pdf)(624KB)(Opens in New Window)’ (Opens in a New Window) has also been produced to explain the process of making the amendments. This also includes a schedule of the amendments proposed. The ‘Policies Map(.pdf)(2 MB)(Opens in New Window)’ (Opens in a New Window) has also been amended to reflect the proposed amendments to the Neighbourhood Plan.

Broxtowe Borough Council Update 14th March 2023

On Wednesday 8th March, Broxtowe Borough Council submitted a draft ‘schedule of amendments’, setting out the proposed modifications, as discussed with the Chetwynd: The Toton and Chilwell Neighbourhood Forum, to the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The Borough Council is currently awaiting the response of the Independent Examiner to this schedule and supporting documents. Further information will be added to this website page when it is available.

Broxtowe Borough Council Update – 28th February 2023

Broxtowe Borough Council is continuing to work with the Chetwynd: The Toton and Chilwell Neighbourhood Forum to produce a ‘schedule of amendments’ setting out the proposed modifications to the Chetwynd: The Toton and Chilwell Neighbourhood Plan. The Independent Examiner has granted extensions to the deadline to allow this work to be finalised. It is expected that the Borough Council and Neighbourhood Forum will be in a position to send the schedule of amendments to the Independent Examiner within the next week or so. Subject to the comments and recommendations of the Independent Examiner at this point, the Borough Council envisages that the schedule of amendments will then be the subject of a further limited period of public consultation.

Post Hearing Letter and Annex: Proposed Scope of the Potential Modifications to the Chetwynd: The Toton and Chilwell Neighbourhood Plan – 19 December 2022

Further to the Post Hearing Note (of 15th November 2022), the Independent Examiner has sent the Chetwynd: The Toton and Chilwell Neighbourhood Forum and Broxtowe Borough Council a letter(.pdf)(f210KB)(Opens in New Window) (Opens in a New Window) and annex(.pdf)(180KB)(Opens in New Window) (Opens in a New Window) setting out further guidance to the Chetwynd: The Toton and Chilwell Neighbourhood Forum on the scope of the modifications that the Independent Examiner considers necessary to the specific policies and sections of the Neighbourhood Plan.

Re-designation of the Chetwynd: The Toton and Chilwell Neighbourhood Forum

In accordance with Section 61F of the Town and Country Planning Act 1990 (as amended), Broxtowe Borough Council resolved at its meeting on 2nd March 2022 to re-designate the Chetwynd: The Toton and Chilwell Neighbourhood Forum for the Chetwynd: The Toton and Chilwell Neighbourhood Area(.pdf)(5.08MB)(Opens in New Window) (Opens in a New Window).

Regulation 10 of the Neighbourhood Planning (General) Regulations 2012 (as amended), requires that the following information in relation to the re-designation of the Chetwynd: The Toton and Chilwell Neighbourhood Forum be published by the local planning authority:

Background

The Chetwynd: The Toton and Chilwell Neighbourhood Forum submitted an application to ‘re-designate’ the Neighbourhood Forum, as the original designation was due to expire on 9 March 2022.

The Forum’s application(.pdf)(244KB)(Opens in New Window) (Opens in a New Window) included the following information:

(a) the name of the proposed Neighbourhood Forum;

(b) a link to a copy of the written constitution of the proposed Neighbourhood Forum;

(c) the name of the neighbourhood area to which the application relates and a link to a map which identifies the area;

(d) the contact details of at least one member of the proposed Neighbourhood Forum to be made public under regulations 9 and 10; and

(e) a statement which explains how the proposed Neighbourhood Forum meets the conditions contained in section 61F(5) of the 1990 Act.

Please note that as the Council has taken the decision to re-designate the Neighbourhood Forum, no other organisation or body may be designated for this neighbourhood area until this designation expires or is withdrawn.

All representations received were carefully considered by the Council prior to the decision being taken to re-designate the Neighbourhood Forum.
